United Nations Working Group on Arbitrary Detention Opinion No. 73/2025 (adopted 14 November 2025) concerning Chinese human rights lawyer Xie Yang.
The Working Group concludes that Xie Yang’s detention since 11 January 2022 is arbitrary under categories I, II, III and V.
Key findings:
Category I: No legal basis — 7-month enforced disappearance, vague “inciting subversion” charges, no arrest warrant shown, and over 4 years of unjustified pretrial detention.
Category II: Punishment for exercising freedom of expression and peaceful assembly (social media criticism, foreign media interviews, and one-person protests).
Category III: Grave fair-trial violations, including long-term denial of chosen lawyer (up to 8 months), forced state-appointed counsel, repeated torture/ill-treatment (chaining, beating, food deprivation), and trial irregularities.
Category V: Discrimination based on his political opinions and work as a human rights lawyer.
This is the second UN opinion finding his detention arbitrary (after Opinion 59/2017). The Working Group demands immediate release, compensation, an independent investigation into the violations (including torture), and dissemination of the opinion.
